Texas Roadhouse Envelope Giveaway

ELIGIBILITY: The Texas Roadhouse Giveaway (“Sweepstakes”) begins and ends on the dates specified on promotional documents and the exterior of distributed envelopes. The Sweepstakes is open to all legal residents of the United States who are 18 years of age or older at the time of entry. Participants must be able to provide valid identification in order to enter and/or claim the prize. Void outside of the United States and where prohibited. Employees, directors, and officers of Texas Roadhouse, Inc. (“Sponsor”) and any parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, and any vendors providing products or services in connection with this Sweepstakes (collectively, the “Sponsor Affiliates”), and their immediate families (i.e., grandparents, parents, children, siblings, spouse) or members of the same household of such employees/officers/directors are not eligible to enter. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.
HOW TO PARTICIPATE: Envelopes containing award notifications will be distributed either in person or by email. All envelopes contain award notifications for either Premium Prizes or Other Prizes (defined below). Each envelope will contain the odds of winning each Premium Prize. Notifications have been randomly inserted into envelopes. In order to redeem the prize, you must follow all rules contained in these Official Rules, including those specified in the Prize and Redemption section below, as well as any conditions specified on the envelope. PRIVACY: Your participation in the Sweepstakes and all information provided by you is subject to Sponsor’s Privacy Policy which is found at https://texassroadshouses.com/privacy-policy.
RULES ON ENVELOPES: All statements, terms, and conditions printed on Sweepstakes envelopes are hereby incorporated by reference into these Official Rules as if they were specifically stated verbatim herein.
LIMIT ONE (1) ENTRY PER PERSON: Participation in the Sweepstakes is limited to one (1) entry per person. Sponsor shall not be responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human or electronic.
PRIZE and REDEMPTION: In order to redeem the prize, the Participant must bring the unopened envelope to the restaurant location identified on the envelope and only on the dates identified on the envelope. Vouchers for Premium Prizes and Other Prizes have been randomly inserted into all envelopes. Premium Prizes are those prizes specifically identified on the envelope. Other Prizes are prizes of lesser value examples of which are included on the envelope, such as Free Appetizers, Free or Discounted Entress, etc. Any envelope that has been opened by someone other than a restaurant manager will be deemed null and void. All prizes other than those for food or drink will be awarded at the time the envelope is opened by the restaurant manager. Vouchers for food or drink prizes can only be used at the restaurant specified on the envelope. All vouchers must be redeemed no later than the closing date of the Sweepstakes identified on the envelope.
The total number of envelopes distributed as part of the Sweepstakes is stated on the exterior of the envelope. All envelopes will include vouchers for either Premium Prizes or Other Prizes which are identified on the exterior of the envelope. The odds of winning any Premium Prizes are stated on the exterior of the envelope. Odds of winning Other Prizes will depend upon the number of envelopes distributed during the Promotion Period and the supply and number of each kind of Other Prize being awarded in the Sweepstakes. Envelopes will identify examples of Other Prizes but may not include a comprehensive list of all Other Prizes that may be awarded in the Sweepstakes.
In the event a Premium Prize is not redeemed by the closing date of the Sweepstakes identified on the envelope, Sponsor will conduct a secondary Sweepstakes to award those unredeemed Premium Prizes.
NOTIFICATION: Participants will be informed in-person of the Premium Prize or Other Prize they have won at the time the manager of the designated restaurant opens the envelope. Winners of Premium Prizes may be issued an IRS 1099 Tax Form for the full value of the Premium Prize.
NO WARRANTY: All prizes are awarded “AS IS”. Sponsor makes no warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or any prize. Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of the winner.
NO LIABILITY & INDEMNIFICATION: Sponsor and Sponsor Affiliates are not responsible for and Participant releases each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the Participant’s ability to submit an entry, claim a prize, or otherwise participate in this Sweepstakes, or Sponsor’s ability to include all eligible entries, conduct random drawings, notify potential winners, or otherwise execute this Sweepstakes in the manner intended. Participants further release and agree to indemnify Sponsor and Sponsor Affiliates from any and all liability, claims, actions, loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may be sustained in connection with this Sweepstakes, including, but not limited to: (a) the receipt, ownership or use or misuse of any prize awarded; (b) participation in any Sweepstakes-related activity; (c) any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action; (d) any typographical or other error in these Official Rules or any other materials disseminated by Sponsor; and (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by a Participant or Sponsor. UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
OTHER TERMS: Decisions of Sponsor on all matters related to the Sweepstakes are final. Sponsor reserves the right to extend, cancel or modify the Sweepstakes for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes, or if a computer virus or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules.
